O ano de 2016 foi particularmente terrível no Brasil para a vivência dos direitos fundamentais. No início de 2016, em um espaço de pace de apenas uma semana, o Supremo Tribunal Federal proferiu duas decisões lamentáveis para os direitos fundamentais em nosso país. Primeiro, no HC 126.292/SP, o STF entendeu que não viola o estado de inocência a exigência de o réu se recolher à prisão se houver uma decisão condenatória em segunda instância. É dizer: mesmo ainda havendo a possibilidade de recurso da decisão, para o STF, nessa lamentável decisão, já seria possível o cumprimento antecipado da pena, em grave afronta à textualidade constitucional! Posteriormente, na semana seguinte, o STF decidiu que não viola os direitos de privacidade e intimidade a Receita Federal ter acesso a informações fiscais e bancárias dos contribuintes, pois não haveria, na perspectiva do Tribunal, uma quebra de sigilo, mas apenas uma transferência do dever de cuidado e de gestão da informação.

Quando todos achávamos que as violações ao Texto Constitucional parariam por aí, a Câmara dos Deputados e o Senado Federal com a complacência do Supremo Tribunal Federal promoveram um processo de impeachment contra a Presidenta da República democraticamente eleita por ter ela supostamente cometido crime de responsabilidade em decorrência de manobras contábeis realizadas no orçamento, conhecidas como pedaladas fiscais.

Durante todo o procedimento, ficou muito claro a todos que queriam ver que não houve cometimento de crime de responsabilidade por parte da Presidenta da República democraticamente eleita, mas que ela estava sendo julgada pelo “conjunto da obra” e por não ter sido hábil em dialogar com o Congresso Nacional. Muitos Senadores, inclusive, reconheceram publicamente que não tinha havido crime de responsabilidade, mas que condenavam a Presidenta da República porque seu retorno traria mais instabilidade ao país! Esse foi um duro GOLPE à democracia e à Constituição de 1988.
Sem que houvesse Emenda Constitucional, mecanismo legítimo para a mudança formal da Constituição, os parlamentares simplesmente transformaram o processo de impeachment previsto constitucionalmente em voto de desconfiança em relação ao Presidente da República. Ora, a Constituição exige para a destituição do Presidente da República que se comprove a existência de crime de responsabilidade. E, no caso do impeachment da Presidenta da República Dilma Roussef, isso não ficou comprovado!
Apesar de tudo isso, ainda acredito na força do Direito, da Constituição e dos Direitos Fundamentais como mecanismos essenciais para uma convivência entre pessoas que são livres e iguais exatamente porque se reconhecem como diferentes e que devem respeitar essa diferença que é constitutiva do nosso caráter humano.
Nessa quarta edição, promovi algumas alterações ao longo do texto, para torná-lo mais claro, introduzindo algumas reflexões novas, principalmente pelo advento da Lei 13.300/2016 que, finalmente, regulamentou o procedimento do mandado de injunção.
Também essa terrível decisão do Supremo Tribunal Federal que desconsiderou o estado de inocência mereceu reflexões no sentido de demonstrar sua completa inconsistência e incoerência em face do sistema de direitos fundamentais que adotamos com a Constituição de 1988.
